Legal Department

1. The mission of the Legal Department of the ME is to coordinate the process of drafting legislation and international agreements within the scope of the Ministry, ensuring compliance with the techniques and standards on drafting of legislation, to ensure the alignment of the legislation of the Ministry with the legislation of the European Union, to offer professional support, legal advice and recommendations to other structures within the Ministry.

2. Tasks and duties of the Legal Department shall be as follows:
2.1. Coordinates and participates in drafting normative acts in close cooperation with the Cabinet of the Minister, Departments and other organizational units within the scope of activity of the Ministry.
2.2. It is responsible for finalizing draft normative acts;
2.3 In cooperation with the departments, units or persons responsible for drafting of draft normative acts, ensures the compatibility of normative acts proposed by the relevant ministry with the legislation applicable in the Republic of Kosovo and the European Union Acquis, including the preparation of the Declaration of Compliance (DoC) and Compliance Tables (CT);
2.4. Gives required legal opinions within the scope of the Ministry;
2.5. Cooperates with the Legal Office in preparing, monitoring and reporting on the Legislative Program and other activities related to the process of drafting legislation;
2.6. Identifies problems of implementation of normative acts, and proposes measures for changing, supplementing or drafting the legislation as well as when necessary offers advice, instructions, professional recommendations for achieving results through the effective implementation of the existing legal framework applicable in ME;
2.7. Cooperates with the State Advocacy Office (Ministry of Justice) for the representation of the Ministry before the Court;
2.8. Coordinates the activities for implementation of the legislation with the relevant units of the Ministry as well as with other ministries and the Government;
2.9. Maintains and updates the register of by-laws of the relevant Ministry;
2.10. Submits by-laws to the Legal Office after their approval by the Minister;
2.11. Ensures fulfillment of legal obligations in implementation of the law and other provisions within the scope of the Ministry;
2.12. Prepares draft decisions, proposals of various materials requested by the Secretary and the Minister;
2.13. Performs other tasks defined by the relevant legislation;
2.14. Assists and coordinates the process of initiatives for international agreements within the scope of the Ministry, ensures that the procedures are in accordance with the Law on International Agreements and keeps records of all international agreements concluded on behalf of the Ministry and its executive agencies;
2.15. Drafts and coordinates the Ex-Post evaluation process of the relevant legislation;
2.16. Participates in drafting concept documents and strategic documents and reviewing thereof to ensure that the recommendations therein are in accordance with the existing legal framework and to ensure whether the need for the adoption of the necessary laws or by-laws has been identified.

3. The Director of the Legal Department reports to the Secretary General.
4. This Department shall be composed of the following Divisions:

4.1. Drafting and Harmonization of Legislation Division;
4.2 Supervision of Law Implementation, Legal Support and Inter-Institutional Cooperation in the Field of Legislation Division.

5. The number of employees in the Legal Department is seven (7).

1. Duties and Responsibilities of the Drafting and Harmonization of Legislation Division shall be as follows:

1.1. Provides assistance in drafting legislation and ensures compliance with applicable law in Kosovo;
1.2. Provides assistance to the organizational structures of the Ministry in identifying issues that need to be regulated;
1.3. Provides legal advice and recommendations required within the scope of the Ministry;
1.4. Ensures the alignment of legislation with the acquis communautaire and the applicable laws in Kosovo.

2. The head of the Drafting and Harmonization of Legislation Division reports to the Director of Legal Department.

3. The number of employees in the Drafting and Harmonization of Legislation Division is three (3).

1. Tasks and duties of the Supervision of Law Implementation, Legal Support and Inter-Institutional Cooperation in the Field of Legislation Division shall be:

1.1. Coordinates activities with all organizational structures of the Ministry regarding the implementation of legislation;
1.2. Provides legal support in the field of legislation;
1.3. Identifies problems of implementation of normative acts;
1.4. Provides legal support in drafting proposal-decisions, proposal-agreements, proposal-memorandums and proposal-contracts;
1.5. Coordinates the legislative activities of the Ministry with the relevant institutions;
1.6. Maintains the register of by-laws of the Ministry.

2. The head of Supervision of Law Implementation, Legal Support and Inter-Institutional Cooperation in the Field of Legislation Division reports to the Director of the Legal Department.

3. The number of employees in the Supervision of Law Implementation, Legal Support and Inter-Institutional Cooperation in the Field of Legislation Division is three (3).
